Something that I keep coming back to: surely the defendants and their attorneys are much more knowlegable on the subject than the judge and her clerks are. Although her ruling/decision/un-decision/partial ruling seems, for now, to be in their favor, they have to realize that she does not grasp the concept and she kicked the can on to someone else's property. They are taking a position as to the claim construction to save themselves money NOT because they do not know or think that they have been infringing on a little company that did not, in the past, have the money or proper representation to fight back.
It will be interesting to see how many of the current defendants sieze this opportunity to settle for peanuts. It will be interesting to see how forcefully DM pushes back. Both will be an indication of how badly EDIG needs the money to continue the fight and how strongly DM and the company still believe that they have been wronged and can prove that belief.
Good to know that a date has been set for the "annual" SHM. Let's hope for a shift in the momentum regarding this court case between now and then and maybe the Innovations group will come forth with something that investors can hang their hats on.
