The way I read things....the defendants got the raw end...their most important phrase is not considered straight out, and I do not read the courts 3 considerations detailing the original patent phrase to show they have any upper hand.

I see (as applicable)

They have the right to take it to the man as well, if that be the case.

IMO, they take it to the man, or we see settlements.
