OTTAWA, Canada – January 10, 2011 – Wi-LAN Inc. (“WiLAN” or the “Company”) (TSX:WIN), a leading technology innovation and licensing company, today announced that Judge James Ware of the U.S. District Court for the Northern District of California issued a claim construction Opinion and Order in ongoing litigation initiated by Intel Corporation (“Intel”) against WiLAN. In the litigation, Intel is seeking that certain WiLAN patents, including U.S. Patent Nos. 6,459,687 (“the ‘687 patent”) and 6,683,866 (“the ‘866 patent”), be found invalid, unenforceable and not infringed by various WiMAX products sold by Intel. The claim construction hearing, also known as the Markman hearing, with respect to the ‘687 and ‘866 patents, was held before Judge Ware on November 19, 2010.
Overall WiLAN is pleased with the ruling. WiLAN believes that based on the Court’s constructions, the Company will be able to demonstrate infringement of WiMAX products.
