Message: How to determine in one infringes

Just got caught up from last nights posts....good points made by many people.

Concerning flash, SanDisk (SNDK) has been in our minds since this IP stuff began, and there was some discussion amongst the attendees prior to the 2008 SHM being called to order. What brought them into the lime light was an offer of $26/share to buy them by Samsung, which was rejected by the SNDK BOD as "under valued." Connecting dots as we call it, makes SNDK a possible target. Not because Samsung wanted to buy them, but do to their product line in the flash arena. I agree Giants...always have had SNDK in MY sites.

It is evident DM is growing their IP side of the business thru strategic additions of lawyers with below avg looks...lol. Right Gil? A requirement maybe? lol Whether they end up being added to the team via Pacer info, we'll see. Could Mark Fischer be getting phone calls in Boston to answer technical questions....possible...why not?

For those of you at the 2008 SHM when Dr Pat N did his dog and pony, he demonstrated how easy it was to determine an infringer by aquiring samples of the companies product line, ie: pulling out the flash chip and "if it stops working they infringe." This was an elementary demonstration of the low hanging fruit tier I types...IMO. Ala TX 7...IMO.

The point I'd like to address, and I think it was pasnthru and biggreydog who touched on this, is how to determine if the AAPL MacBook Air is using chips with EDIG tech inside, regardless of who manufactured them. Here's a quick side bar after the 2008 SHM I had with Dr Pat N...something like this but not an exact quote (too long ago)...Q: Pat, how did you guys make up the list of 174+ claimed infringers? A: Lots of late nights studying companies products and having pizza delivered. NOW, somebody try and convince me DM is not going to buy an AAPL MacBook Air, send it to Dr Pat and company, to be analized, along with whatever assistance the DM techy experts like James Sze of DM here in San Diego can offer (former QCOM Engr)? "Late nights, pizza delivered, studying products, making the list of 174+."

This should be obvious , to be a well planned and orchestrated tactic by both legal and technical experts, and IMO we are holding all the aces up our sleeves.
