He wants that Markman Ruling before the TIER III Filings. What better way to hold firm for the bigger settlements to have more to cover costs at TIER III.?

Either way you look at it it is a WIN/WIN situation for EDIG, they will have mre money in the Bank, and a poistive Markman in hand going after the BIGGEES.
