For both taking the time, and the kind words. (Yes we have strongly disagreed in the past on some issues but always respectfully and you were more often right)

I said I would not post about the reexam (unless asked) This was a form of asking.

Very quickly, I do agree with you that a reexam is unlikely at this time.

IMO, If the Markman Hearing results favor the opposition than a USPTO review is LESS likely, If we have a strong win (and I feel we will) then a review is MORE likely because as you say, and as I have said, it delays us.

BOTTOM LINE

If we are going to have a review at some point, why not get it started NOW, so that it is over sooner?
