I completely understand what you are saying, but some of us have heard word that what has been suggested re: Wencor Blunder is true. Source? Ultimately, I have no idea. But it does seem an unlikely proposition if there weren`t an element of truth (but who knows, with supposed re-orders for 3,600 units from Alaska, two 40,000 orders ``committed``, four 10,000 unit orders pending, and other such non-sense, which time proved to be un-true).

But I will plant a contrarian thought in your head: IF YOU were Brent Wood (AKA Wencorman), and did your DD to find that EDIG was the guts of the device and that Boyer only brought the shell, name, and a few small customers to the party, what would you do? Yeah, ``digEplayer`` had already established itself as a name, and that`s worth something. The shell can be easily changed. The small customers can be easily replaced.

If it were me and I was that sharp, I`d go to the real source directly. If APS had an exclusive arrangement with EDIG (which I personally doubt at this point), I`d pay off APS to eliminate that provision (which may have been the real reason for the APS acquisition, or so I thought, and they probably paid too much if they did). No exclusivity between APS and EDIG? Then the end-run would be a walk in the park. I`d capitalize on the established name and gratify eDigital by naming the device the EdigPlayer - close enough to the ``original`` name to maintain identity/recognition that it`s the same thing while being the stock symbol of my technological partner (so no Trademark dispute). Studios may be an issue, but with identical technology, and the prospect of a great deal more business, the studios would probably sign on without hesitation.

Then I`d push the heck out of it, and I`d buy an equity stake in EDIG for piece of mind and a seat on the board.

In other words, I would have walked over APS (at a minimal cost, if any), pushed for an exclusive with EDIG (which I`d ultimately get with my equity stake and board representation, or by pure heavy-handedness). After a while, I`d rework the deal to where I performed manufacturing oversight to limit EDIG to royalties and a retainer for engineering support when needed.

So if I were a really smart guy in Wencorman`s position, with all the facts in hand, that`s what I would have done. Of course, he may have not had all the facts (as some suspect) and there may have been other factors (though I can`t really think of what any could have been).

Just another perspective....and Monday-morning quarterbacking! LOL
