FWIW....even if I had access to the prosecution history and had an inkling of understanding of the posturing of the applicant.....I would still have been an investor.

So in that regard, it wouldn't have made a difference.

However, we are now at that bridge and must cross it....I would most certainly consider that DM scrutinized with detail the lay of the land established by Thorpe, North & Western when they considered a 75% chance of victory.
