(1) May 3rd, 2010 was the deadline for Joinder of Parties and Amendment to Pleadings .

(2) May 4th, 2010 is the deadline for filing any Request for Production, Request for Admissions, Claim Construction, Interrogatories.

(3) May 7th, 2010 is the deadline for filing a Joint Claim Construction Statement.

(4) May 24, 2010 is the deadline for service of rebuttal expert reports of any expert who will be providing rebuttal testimony of any fact witness who will be offering rebuttal testimony at the Markman Hearing, along with a detailed summary of any testimonyby any rebuttal fact witness who will be offering rebuttal testimony at the Markman Hearing.

If by tonight there is no PACER activity with respect to (1) AND (2), that is a good sign. That could only mean there is no BIG FIGHT going on...

May 7th is first chance we may see some "Settlements". As it makes no sense to continue with if you are a defendant who already has considered settling with EDIG and not go through the Motions for Markman Hearing.

May 24, 2010 is where the Rubber Hits the Road. For getting all your experts lined up and decide who gets to say what, and divulge their statements to opposition is some serrious Trial Preparation.

IMO we will get a number of "settlements" by that date...
