Royalty bearing agreements

Can DM negotiate royalty agreements beyond the expiration date of the patents going forward? I guess they can negotiate any deal palatable to both sides.

While Wolverine is a small company, I wonder when the accounting for the royalties kicks in and how long they are bound by this agreement.

"Under the terms of the confidential agreement, Wolverine has agreed to make an undisclosed lump sum payment for past infringing sales and to pay a royalty for any on-going sales of products that practice e.Digital’s U.S. Patent 5,491,774 ('774)."

So far, one of 10 settlements has gone the way of the royalty. Is this an isolated incident or representative of a trend....10% of the entire infringings body?
