Message: DONI -- with/without prejudice

doni, requesting a motion which includes the language, "The granting of this motion will not prejudice any party", is completely different from a court order dismissing a party "with or without prejudice."

The former is simply stating that if the court allows whatever the motion is, it won't be detrimental to either party in any manner. The latter means a defendant was dismissed from the lawsuit and either can be sued for the offense again (without prejudice) or can't be sued again (with prejudice).

Give me a few mins and I'll research how Casio, Nikon, Olympus, Sanyo and Avid were formally dismissed re: with or without prejudice.
