This is what I have been thinking as well since Fri, but decided to leave it be until now, so thanks for bringing it up emit. If I'm not mistaken, the 1st Markman was SCHEDULED for 2/17/10. We got all worked up with how long the Samsung suit was taking, and the thought was we were going there. Well, did not happen.
Before we repeat that thought process, what I interpret from the 1st experience behind us, is the legal rambling required the court to SCHEDULE a Markman. There are 20 listed on CO_Doc240, which amounts to 15 companies.
Time for a requote by RP at the SHM 11/19/09, when asked about going to Markman...close as I can remember and paraphrased a bit..."rather than getting involved in a 3-4 year court ordeal, it is in our best interest for the goal to be a settlement, but 1 or 2 of the 19 may want to take us there." I have posted this statement many times. And, "there may be some surprises in these 19."
I/we need Gil's help here, but before this poster comes to the conclusion that NOBODY will settle before the fall when a Markman is SCHEDULED, I'll just wait and see. With 11 settlements under our belt, of which 7 could have taken us to a Markman, who's to say it is a forgone conclusion all 15 want to go there? I'm not inclined to buy that theory.
This forum being what it is, means we offer opinions, so this is mine. Obviously I have no legal basis to offer the above, but common sense requires me to mention it.
