Their newly formed US direct sales outlet 2004, ...is being processed on the Colorado list... DXG Technology,(USA) Inc .....shortly its to be decided if DXG Technology, Inc. will be as well.

I guess it all depends on how DM can stop the USA unit from functioning, if the challange is to happen, along with the wait for the legal system to straighten it out.
