This is not a debt, it is the cumulative losses that they generated over the years, from inception until now, as we start seeing income generated they can apply these losses against future earnings, it is called net operating loss (NOL).

The subject of NoL is complicated it has its own carry back and carry forward period limitations and expiration period, but for the sake of simplicity let us say and this is an example this year they generated $80 million in IP litigation they can apply the $80 mil NOL and pay no taxes on the income.

As I said this is just an example which is close to reality, but reality is a little bit different.
