There have been companies that took their cases the distance, won the court decision only to wind up with little net return after considering costs and time spent.

Most attorney's go into litigation planning to settle. According to you they don't consider that a win for their clients. I just disagree with your definition of winning.
EDIG wins as it grows its revenue base and it looks to me as if that is the plan currently ongoing.
