"I'll take the over, way, way over at 5 mil, being the second tier we should start out with larger settlements."
Not tier 2 but round two... only the ‘774 patent was mentioned in the action against the Colorado 19.
I haven’t been able to figure out how DM can expect more money from settlements among the 19 given that the amounts from round one are easy enough for infringers to determine. DM has already shown that they’re more than willing to settle and appears reluctant to take a case all the way to court just yet. Why would any company pay us more than 1-2 million at this point?
I do like what appears to be their strategy of delaying notification and attempting to negotiate and settle quickly thus saving some legal costs on both sides. Maybe if they can land 6-10 1-2M dollar settlements in short order, they might begin the process against some tier 2 infringers and be prepared to go the distance with them. Hard to say.
I’m hoping that in the next 3 months we will see multiple settlements, a major eVU order, and real growth in investor awareness and interest. I’m thinking it will take several things coming together in the right way before the share price can move up in a meaningful way. Here’s to (early) 2010!
