That is an astute observation, if you mean that DM is aiming for building a "WAR CHEST" first, before going after the TIER II and TIER III infringers...

1) There is no question that DM thought about this case a year before getting involved with it...

2) It is also standard practice the make an assessment of the "COSTS" to the law firm before one accepts a case which may get one involved in protracted litigation. And the costs involve both monetary and reputation of the law firm...

3) You can bet your last share of EDIG that DM during the time period they were reviewing the case, devised a PLAN which demonstrated to the Commettee of their Senior Partners that EDIG would have a 75% chance of being a "Profitable" case for the the Law Firm, before they took up the representation of EDIG on a contingency basis with the added proviso that the law firm would front the costs of the law suit...

Thus, "going after the easy kills" as you put it, is consistent with a PLAN by DM to build their "war chest" and should not be construed that DM was aiming to get their costs they had fronted back, and get their 40% FEE and bail out on EDIG as it has been discussed here in recent days...

Being from the BAY AREA you should recall the ALL STATE SLOGAN, "YOU ARE IN GOOD HANDS WITH DM", and they know what they are doing...
