When the meaning of a claim is contested, many courts will hold a preliminary "Markman hearing" to resolve as a matter of law, the meaning of the claim which defines the scope of the patent grant. This usually requires expert testimony, either technical or patent or both.

Prior to the Markman date, are we in a trial.....is the paper process we are following considered a trial....this is where I question things and people seem to get upset.
