digEcor is also pleased with the court's decision to dismiss as a matter of law a portion of e.Digital's counterclaim where e.Digital sought to recover revenue from digEcor. Furthermore, digEcor is pleased that in a prior order dated December 15, 2008, the court dismissed all of e.Digital's claims that digEcor had misappropriated e.Digital technology in some way. In light of this order, e.Digital can make no claim that digEcor has misappropriated any e.Digital technology, and all prior suggestions made by e.Digital to this effect are conclusively established to be without merit.
Is it possible that edig dropped this claim so if the Judge ruled against edigital, then edigital could never go after Bow to recover for the stolen IP.
Since there was no ruling on this claim, edigital can have DM file a separate suit to recover for infringement. I think edigital knows for sure if Bow stole their IP through the depositions of Triad Engeenering and others.
My guess is this was a strategic decision to drop this claim so now we can hit them hard with all the solid information obtained from this suit.
I can see digecors new press release come out crying how the Judge came to the wrong decision.
