If IYO they may be getting close to settlement talks, why delay this court stuff and just get on with it?

Not sure I follow the logic, yet thinking along the lines of shaking hands on some sort of a deal and skip the balance.

I know it is "unpopular" to make statements that this may not go all the way to Markman, but there remains the possibility. Is this what you are trying to convey?
