AGREED MOTION FOR AN EXTENSION OF TIME TO RESPOND TO

SAMSUNG’S MOTION TO STRIKE E.DIGITAL’S INFRINGEMENT

CONTENTIONS WITH RESPECT TO 20 ACCUSED MOBILE PHONES

COMES NOW, Plaintiff e.Digital Corporation (“e.Digital”) and with agreement from Defendant Samsung Electronics America, Inc. (“Samsung”) files this Agreed Motion for an Extension of Time to File a Response to Samsung’s Motion to Strike e.Digital’s Infringement Contentions with Respect to 20 Accused Mobile Phones, and in support thereof respectfully shows the Court as follows:

On June 23, 2009, Samsung filed a Motion to Strike e.Digital’s Infringement Contentions with Respect to 20 Accused Samsung Mobile Phones (D.I. 162). Under this Court’s Local Rules, e.Digital’s response to the Motion is to be filed by no later than July 8, 2009. (E.D. Tex., Local Rule CV 7(e).) Due to the press of business, e.Digital has requested, and Samsung graciously has agreed to a nine (9) day extension of time for e.Digital to file its response to the motion such that e.Digital’s response now will be due on July 17, 2009.

FOR THESE REASONS, e.Digital with the agreement of Samsung respectfully requests the Court to enter an Order Granting the Agreed Motion for an Extension of Time to Respond to Samsung’s Motion to Strike e.Digital’s Infringement Contentions with Respect to 20 Accused Samsung Mobile Phones.
