And it has been explaind here in multitude of posts that DM is following the logical path of getting their MARKMAN DECISION before they engage the next round of Infringers...

Mrkman Hearing is in February of 2010. And a Decision by Judge WARD shall not take much longer after that...

Wehter the actual Law Suit naming several New defendants will be filed before or after the Markman Hearing shall depend on who are going to be named in that law suit. A decision which only DM makes in light of their strategy regaring the overall case...

Ther is absolutly NO, an I mean NO basis for thinking that there will not be additional infringers named in a law suit by DM...
