These must have been very late filings yesterday because they weren't on PACER around 8pm MST. Not sure if a settlement is pending but they sure are doing some very heavy negotiating as we near the trial.

• digEcor requests 3 claims of theirs (Lanham Act-Federal Unfair Competition, Common Law Unfair Competition, and Statutory Unfair Competition) be dismissed along with all claims against Fred Falk and William Blakeley.
• EDIG requests two counterclaims (defamation and tortious interference) be dismissed.
• EDIG requests all counterclaims remaining in EDIG's pleadings that seek monetary damage awards against digEcor be dismissed. WTF?

digEcor's motion yesterday (Doc 344) in opposition of EDIG's motion (Doc 331) for partial summary judgment on the breach of the duty of good faith and fair dealing claim was a tad late. The judge ruled in favor of EDIG on the same day (Doc 342). LOL
