Plaintiff digEcor, Inc. and Defendants e.Digital Corporation, Fred Falk, and William Blakeley hereby stipulate, through their counsel, to the authenticity of all documents produced by the parties in this litigation. The parties agree that all documents produced and bearing control numbers beginning with "DIGECOR XXXXX" or "EDIGITAL XXXXX" are presumed

authentic pursuant to Rule 901 of the Federal Rules of Evidence and that no extrinsic evidence of authenticity shall be required as a condition precedent to admissibility of these documents. This is a stipulation regarding authenticity only. It is understood and agreed that any party may object on any other basis to admissibility of said documents at trial. Further, where good cause appears, and notwithstanding the foregoing, the presumption of authenticity of any document may be rebutted by any party at trial, where that party introduces evidence or argument which reasonably calls into question the authenticity of such document.
