LL, I don't follow you. We have an active case against Vivitar. Just because Vivitar has been sold and isn't cooperating with their attorneys doesn't excuse them from following court mandated schedule dates does it? If Vivitar ignores the case schedule, and is not present for the Markman Hearing in May 2010, won't the judge just hear DM's Claim Construction arguments?
