digEcor and EDIG filed a joint motion today to have a Settlement Conference Mediation conducted by Judge Nuffer. Very encouraging IMO.

The parties, digEcor, Inc., e.Digital Corporation, William Blakeley and Fred Falk, through their counsel, hereby stipulate and move the Court for an order permitting the parties to participate in a settlement conference conducted by Magistrate Judge David Nuffer, as soon as his schedule, and that of the parties, will conveniently allow. The parties agree that Judge Nuffer is well-positioned to assist in their settlement efforts because he is generally familiar with the facts of this case. Neither party perceives any disadvantage or prejudice that could result from Judge Nuffer’s referral to, or past work in, this case. Therefore, the parties respectfully stipulate that the Court enter the proposed order submitted herewith authorizing Judge Nuffer to conduct a mediation and terminating the referral to Judge Nuffer that was made in this matter on July 28, 2006 (dkt 25). Given the late stage of this litigation, and this Court’s statement at the most recent status conference that it intends to rule on the pending motions for partial summary judgment and the other pending collateral motions, and then will proceed to trial thereafter, the parties do not anticipate that further referral to a magistrate judge will be needed.
