If you check out Doc 294 on box.net, the first sentence reads,

"Pursuant to the stipulation of counsel of digEcor, Inc. and counsel for e.Digital Corp., digEcor hereby withdraws its Motion to Quash Subpoenas and For Protective Order..."

We don't know what the stipulation (agreement) between counsel was.
