You are quite technically correct. Someone elses settlement won't mean "squat" in a court of law. However, just my weird sense of reasoning says that a company faced with a Markman hearing and knowing that 5, 9 or 20 other companies have see fit to settle their claims brought by EDig will give that company a real pause as to their ability to make a case of innocence and win a case that has been acknowledge by many others as having infringed.

And to boot they are using the same IP.

I have to think the big boys in that company will at least have some thought as to braving a Markman hearing
