Copyright verdict in Tyler

On October 20, a Tyler jury in Judge Leonard Davis' court found for the plaintiff in Mathworks v. COMSOL AB et al., 6:06cv335-LED. The jury found that both of the accused products infringed the plaintiff's copyright. , and set damages at $4,526,596. The jury also found that the defendant breached the parties' contract, found that the contract claim was not barred by waiver, and assigned contract damages of $5,382,750.
A hearing on the plaintiff's request for a permanent injunction is set for November 20.
Interestingly, the plaintiff in this case was a defendant in a Marshall patent case a few years back. My recollection is that Mathworks lost at trial and the judgment was later affirmed by the Federal Circuit.
