Personally I wouldn't mind if they chose to settle with Vivitar and then got an earlier (than mid-2010) Markman date with one of the other defendants.

Or is it DM's strategy to wait until mid-2010 before seeing any payoff? I sure wouldn't think so. Could this be why the date seemed acceptable to them (figuring Vivitar wouldn't make it that far anyway?)
