"infringing parties" as designated by EDig....not stating "party's being sued right now"

Just what would be the rational to sue a company for, lets say, $100,000,000, feel you have an excellant case to win on one hand and on the other "negotiate licenseing" with the same company that might bring in pennies on the dollar.

That company would have "an out". Gets down to the short hairs and the company says "we are losing" OK we will license, heres a few bucks....

Do you think DM would go for that????
