If you apply Ron's thoughts to EDIG, the issue would ssem to be moot. EDIG does not have licensees today and the ruling simply states they language of the license agreement is critical.
IMO, DM will fully understand this twist and comply should they begin writting license deals soon.
Obviously, these times are a changin' as someone much cooler than I once wrote.
