The $4M number is the estimate for the "other" guy; a.k.a. Mean ole copy cat?
Obviously, it would "cost" DM less as they are not billing profit dollars and the other guy's attorney (s) will be billing profit. Right?
My point being it is less expensive for DM than for mean ole copy cats.
I KNOW the $750 per hour attorney we hired in Houston to play on our team in from of Judge Ward was good and he settled the case very quickly within my budget. However, had we gone to trial -- even a small case like ours -- would have been $250,000+. As it ended, we paid a few thousand dollars in legal fees and had the deal we could easily pass along in higher OEM fees as royalty payments.
I have no idea if DM wants to settle a case first or send a "we take no prisonors" message with a Markmen win & trial. Any speculation?
