- e.Digital still has active subpoenas served on some of digEcor's clients.
- digEcor also has active subpoenas served on some of e.Digital's clients.
- e.Digital had filed a motion with the Court (Doc149) to quash digEcor's subpoenas.
- digEcor has also filed a motion to quash e.Digital's subpoenas (Doc164).
On 25 Apr 08, e.Digital filed a motion (Doc177) to withdraw their motion to quash digEcor's subpoenas since both parties apparently reached an agreement to limit the scope of the subpoenas that digEcor served on e.Digital's clients.
From Doc177 filed by e.Digital:
- Defendants e.Digital, Fred Falk, and William Blakely (collectively, “e.Digital”) filed their Motion to Quash or Modify Subpoenas on February 28, 2008. (See Docket #149.) The parties have now reached an agreement on the substance of that motion, obviating the need for the Court to rule thereon. The parties hereby notify the Court and all other interested persons that e.Digital withdraws its Motion to Quash or Modify Subpoenas (Docket #149), based on digEcor’s agreement to limit its subpoenas that are outstanding to Lufthansa, Air France, Alitalia, and Malaysian Airline...
As of now, digEcor's motion (Doc164) to quash e.Digital's subpoenas of digEcor's clients is still active and has not been withdrawn by digEcor.
