Will they take the risk in a trial by jury when it is clear EDIG was well founded in the flash arena and their patents well established in time and products?
I think that's their problem and they are looking to cut losses and not trash their company with a potentially debilitating negative judgement. They likely already have a number in mind that they would be happy to write the check today if possible....lol.
If DM and Nunally demonstrate EDIG's pathways via the patents, they are cooked. My bet is there will be significant settlements.
EDIG has always made the case for their patent portfolio, long before it was ready to go to court to defend them.
