I am no attorney and have granted you license to correct me anytime on legal matters. I have read and re-read page 13 to page 19 three time times and it is very clear to me the judge told BOW to take a hike regarding "exclusivity". The DRM referred to is only exclusive to the Digeplayer and the aircraft industry. All other avenues are wide open to EDig.

As the judge has stated the DRM which does not include the RBE is a different product thereby negating the "elclusivity" BOW thought he had.

It boils down to the NDA. Does that NDA state EDig cannot compete in the aircraft industry for any reason using any products whatsoever? Or does it state EDig cannot compete in the aircraft industry using the Digeplayer with the DRM that is in question?

MY reading of those 6 pages says EDig cannot compete using the DRM technology in the Digeplayer but can compete anywhere, anytime if it isĀ using a different product, (the eVu) that does not have the same DRM in it.

So exactly what does "exclusivity" mean??
