Apple in Suit Over iTunes, iPod


A little-known technology company is threatening Steve Jobs' moneymaker.

ZapMedia Services on Wednesday filed a patent infringement suit against Apple over iTunes and iPod technology.

The Atlanta, Georgia, technology company claims that the Mac maker violated two of its patents that cover iTunes- and iPod-like features. The patents held by ZapMedia describe a “system and method for distributing media assets to user devices via a portal synchronized by said user devices.”

The lawsuit, which seeks Apple royalties on revenues related to iPod and iTunes, was filed in the U.S. District Court of Texas.

ZapMedia said its move comes after the company made multiple attempts to come to an agreement with Apple.

"When someone takes our vision and our intellectual property without a license after several attempts, we have no option but to protect it through every means available to us," ZapMedia General Counsel Robert Frohwein said in a statement.

Apple launched its iPod music player along with the iTunes software in October 2001. The company's iTunes store was launched April 2003.

Since launch, iPods and iTunes have done nothing short of revolutionize the music industry, crown Steve Jobs consumer electronics king, and place Apple in high favor on Wall Street.

Apple is now the No. 2 music retailer, behind only Wal-Mart.

Shares of Cupertino, California-based Apple were flat in midday trading at $127.39.

Apple did not immediately respond to calls for comment.
