That makes sense. I've not worked with the HUGE legal firms, but I have been on the wrong end of the gun with one of them. Deposition Day was not high on my list of Things I Want to Do Again. I would have rather had my knee drained -- and that's not a picnic either.
So, when these big guns get involved -- and I believe DM will see the best and brightest guns available when they sit down with most of the seven listed mean ole copy cats -- will it likely to the defense advantage to stall and drag the case out? Hmmm....if I were running the Division in question I would ask my engineers if we were guilty and if it would be easy to spot our infringment. Then, based on that answer, I would proceed. If we were guilty and easy to spot, I would want to settle quickly to move past the suit. If we were not guilty or guilty and not easy to spot / prove, I'd probably stall and wait for a Markman ruling. At that point, I'd know how cooked my goose might be.
In any event, I don't see any of those mean ole copy cats lying down and paying a license fee without a nasty fight. Of course, our guns are loaded. We just need a battlefield date and time. We know the place is Marshall, TX -- not too far from you. If it gets down to the, ugh, cutting time, are you going over to the courthouse?
