It struck me sometime ago that our confidence in DM was well founded. High powered, smart and successful. DM took up EDig on contingency which is fairly unusual as many reports have stated here lately from what appears to be good sources. That stated, DM filed against Vivitar. Contrary to my original belief that Vivitar was number one due to it being the easiest mark that could be found and DM/EDig needed a "win" to procede against the bigger fish, I now feel there is another dimension we are all overlooking.
Surely DM would have done its due diligence and one of the primary facts coming from that DD would have been could Vivitar "pay" if it lost the case. That would have been first and foremost on their radar scale.
We all know the partent company of Vivitar is fooling around with "bancruptcy" noises which means the funds would not be there should this thing go EDig's way. Certainly DM would have known this so there has to be something else here we know nothing of nor have speculated on.
I know we all have come to the conclusion it takes time for these things to work themselves out but too much time has passed, in my estimation, without any word of anything going on.
My thoughts are wandering here but could it be the real target of DM is not Vivitar but their clients??? From what we have heard there are many of them and could prove to be bigger fish than Vivitar alone. Perhaps what we will be hearing first is news from that sector. It seems funds would be tight from Vivitar but no so from its business partners......
Just a shot in the dark sitting here with nothing to do but certainly if Vivitar is found to be an infringer then all partners it supplied EDig's IP to would have absolutely no defense claiming innocence.
Ah well, back to solitaire...
