When you consider their infringement payouts factor out at .004% of revenues you understand why settlement is such an attractive course of action to protect the Trillion dollar market over that time period. 

Would they risk jury verdicts 10 or 20 times settlement options especially where flash is concerned?  Clearly EDIG was there first armed with patents...it's time to pay the piper.
