IMO....any company that can prove they have the ability to implement flash,  could step in and sue Vivitar or similar companies.

Sandisk , Lexar....etc that devise/manufacture flash platform standards have the ability.....however, their business models are already pointed.

When it comes to embedded flash(non removable)....it's a different story.

The Sandisks, with their pointed business models,  could not sue at this level...especially if they manufacture slot flash that is designated on a device.
