I think it's related to a new precedence set recently in a IP infringement case (it was posted on the board previously -whereby the plaintiff should sue first and then negotiate). I was first thinking KLS vs Teleflex but that has to do with prior artwork.

I think I'm in the ballpark but I'm sure someone can pick up on the specifics
