I have a blank NDA for two separate legal firms that we use whenever it is necessary or requested by someone wanting to show us a potential new product or method to get "the right tone." Not to long ago, I received a letter from an attorney wanting me to sign a second NDA because his client had signed one of my blank ones and this attorney didn't think it was valid. I called our attorney and he told me to tell the other attorney to go to Hades, in a hand basket or something like to that effect.

Bottom line: I now have three NDAs and all are different. It is my opine that this is not a black and white legal issue as there are restraint of trade issues that can, and are, interpreted differently by different legal firms and judges.

This should, IMO, be a good thing for EDIG since Boyer's statement is very clear as to what went down no matter what he cries about. In addition, the judge will know that Wencor actually went to the factory and knew about Maycom’s production problem. Certainly, EDIG was contracted to provide the oversight, but Wencor cannot prove EDIG had informed them of the delays or that EDIG acted with malice, IMO.
