EDIG is in a better position now than it has been in years and the FUDsters can’t stand it. New eVU customers Mezzo, Malaysia Airlines, Lufthansa, Alitalia and more to come. The powerhouse DM at bat with IP infringement and prepping to hit a homerun. Will Blakely at the helm and gettin’ er done!
The 2002 NDA is likely still in effect but how the court will interpret that NDA is still a huge unknown. Does it only prevent EDIG from selling to Alaska Airlines, since that was the airlines Bill Boyer had in mind when he came to EDIG? Does it only pertain to “certain Confidential Information” provided by Bill Boyer as is written in the NDA? Does it only pertain to components that APS, Inc (digEcor) manufactured and designed as is written in the NDA? And as has been mentioned here before, courts look disfavorably on NDAs with excessive time periods, the most common being only 3 years, not 7 years. Courts understand companies need new business to grow/survive and don’t want lengthy NDAs to stifle that growth.
