Since this Supreme Court ruling occurred in January it could very well explain the delay in announcing the law firm.

"Because our flash memory-related patent portfolio covers hundreds of companies and thousands of products and extends our rights under the patents until 2015, the law firms we have contacted are being very thorough in their searches for prior art and their due diligence of our patent portfolio." 

I'm sure Duane Morris was aware of the Supreme Courts dockett and I'm certain they were rigorous about their "due diligence" and investigating that "prior art".
