From the 2002 NDA:

 

This Agreement shall govern the conditions of disclosure by WILLIAM J. BOYER, JR [now digEcor] to RECIPIENT [e.Digital] of certain “Confidential Information” including but not limited to prototypes, drawings, data, trade secrets and intellectual property relating to the “Patent Pending” any and all products and/or materials disclosed in confidence by WILLIAM J. BOYER, JR.  With regard to the Confidential Information, RECIPIENT hereby agrees:  (Document then cites 7 stipulations which both parties agreed to.)

 

The above paragraph, and the succeeding 7 Agreement stipulations, only pertain to certain Confidential Information disclosed by Boyer to RECIPIENT.  It does not pertain to the eVU which uses different technology, is of a different design and is not part of Boyer’s Confidential Information. 

 

I find it amusing that bashers are desperately doing damage control on another thread, trying to spin the Court’s rulings as negative for e.Digital.  Of course, they leave out damning sentences by the Court such as,

 

  1. Plaintiff’s Motion for Partial Summary Judgment on Liability and Damages.  The Court will deny Plaintiff’s Motion for Partial Summary Judgment on the issue of liability and general damages.  The motion is premature as there has been no discovery in this action.  Moreover, Defendants have established by affidavit and other evidence that there are genuine issues of material fact, including whether Plaintiff performed under the contracts and whether Plaintiff contributed to any breach of the contracts.

     

As e.Digital becomes successful, bashers become cyber has-beens.  Probably too much for them to cope with on a Sunday afternoon.  LOL.
