Gil, You ask, "Is this something you can post here for everyone else to read?..." -------------------------------------------- I was responding to the following post by FLEagles. --------------------------------------------- "A stipulted Motion for an extension of time was filed on 10/10. asking judge to extend time to file briefs in support of Motions for January Hearing. Relevant part of the stipulated Motion in my opinion is: #2"Edigitals reply memorandum in suuport of its motion for judgment on the pleadings as to the scope of exclusivity uner DRM agreement. The hearing on these motion has been continued until 1/9/07, and these extenstions will permit the parties to inform the Court on the status of the delivery of the 1250 digeplayers referenced in prior briefing." Sounds like Judge wants to know where these players are.? THoughts?" ----------------------------------------------- Thats what the little "Re:" stands for......when you click on "In responce to"....My responce was. ------------------------------------------------- I've read this "New Pleading " several times now and can't figure out whats going on. If I were guessing and this is purely a guess. I'd say it's eDigital that has filed this pleading to respond to Wencor's pleading from earlier in the month. The fact that it was filed on the 10th means it was before the 1250 units were received at customs and the outcome of that still remains an unknown. I believe eDigital has 30 days from Wencor's pleading to cross file. I would think the extension is intended to finalize an outcome for the 1250 digeplayers. It may take a time frame beyond the end of October to do this. This will allow eDigital to submit a brief.....(additional pleading). It is not intended to reschedule the hearing date. Although this may be an unintended result. Am I understanding this correctly? Larry ---------------------------------------------- Legal Eagle then responded to my post. ----------------------------------------------- Most likely they just didn't get the brief written in time and needed an extension. Eagle ----------------------------------------------- Which pretty much says it all. Larry
