You never did respond to Legal eagle's post to you. How about it? Re: News is - Java Posted by LegalEagle on October 07, 2006 at 2:58PM In response to News is by java The demise of edig. From a well placed source. Well, that would indeed be bad news, though your assessment hardly seems possible. Let me ask some questions. 1. Who is your source? If you can't identify by name, at least give us a job description or how this person knows anything about the case. A lawyer? I am a lawyer, have read all the pleadings, have had some other lawyers read the pleadings, and none of us can see any strength in the wencor case. Is it the judge himself? He has told you the decision in advance? Give us some basis for your opinion other than "someone told me," Otherwise it sounds like Emma telling us that "good news is coming but I can't tell you who told me." 2. So I suppose if you think this is true you have sold all your stock? ARe you a shareholder? If I were a shareholder and REALLY thought the end had come I would have a little more emotion in my posting. I CAN'T believe what I just found out after ALL these years they did this STUPID thing that is losing the lawsuit and jeopardizes the entire company. 3. But there lies the real question. How would a loss in this lawsuit jeopardize this company to its demise? (And let me say the pleadings suggest the opposite). What, they have to pay wencor for 1200 digeplayers? Read the prayer for relief being sought by wencor - it's not even all that encompassing. Or they find that they don't own all the rights to the digeplayer? Is that the first generation? What about the second - the EVU? That is not even covered in this case. Can edig sell EVU to to the airlines, but not digeplayers (assuming they lose part of the case). Do you think the airlines would have an opinion on this? If so, they , and wencor's customers, would not be coming to edig would they? Then why are they? And speaking of airlines, wencor only asked that edig stay out of the IFE space for a period fo some years. Does that mean they could still sell EVU or Digeplayers into the healthcare or other industries? Is there a theme here? How could the limited scope of this lawsuit be the demise of edig? Help us out here. Maybe edig has to (if they lose, which I can't see at this point) pay wencor royalties for usage of digeplayers in the IFE space but are not affected otherwise. How does that affect their ongoing viability? 4. Last, perhaps you have noticed that edig is planning to bring legal action to enforce patent rights against a wide array of electronics companies. This, of course, is an entirely different arena than digeplayers and IFE. What does the wencor suit have to do with this? How can their demise be at hand if they have this revenue stream in place? Man, I could go on and on. And I would, but I am tired. And the conclusion you drew from your "secret" information was so off the charts. So fill us in. Give us the skinny. Share your pain with us. Or else we will have to assume your 5 or 6 line post was not really based in fact and had some purpose other than to inform and commiserate.
