He said that the 2 actions were like comparing apples and oranges. They have contracted legal council in Utah where the federal court is hearing the case. A date has been scheduled but he wouldn`t reveal it as court dates are often changed. Any additional documentation from either our side or Wencors would affect the date.
When I asked him about how the process of selecting a legal partner was going I had done some research beforehand on the internet, identifying several high caliber lawfirms that had offices in the SanDiego area. I reeled off names like Thompson, Thompson and Crew; Ropes Day; Fish and Richardson; Morrison and Foerster. I continued I don`t expect you to acknowledge who you working with but my point being that some of these firms are among the most prominent and well respected lawfirms in the country with histories going back over 100 years and client lists representing the same companies we have identified as infringers. How are we going about sorting through this process.
He said that it was likely that we would partner with 2 or even 3 lawfirms because of conflicts of interest. Pat Nunally had identified hundreds of potential infringers and there was no one firm that could possible handle them all without conflicts of interest. We talked about the importance of the stature of the firm. That will be one of the considerations as the process moves forward. A lawfirm of stature can expedite the litigation / negotiation process much more expediously than a small firm.
At the WAEA eDigital had their own booth. The didn`t share on with anyone else as we had thought. He said they had a great show. There we several interested parties. (I took that to mean airlines but it could have meant just about anything.) It didn`t sound like we would be hearing much about these relationships because of our ongoing feud with Wencor. If we were to announce something Woods would attempt to foul it up.
There were many more questions I could have asked but didn`t. My own take is that the business updates will be few and far between with not a whole lot of substance until we settle things with Wencor. Putnam took nearly 2 weeks to respond to my call. I think thats the longest I`ve had to wait for a responce.
