Lots of un-answered questions.... Unfortunately, I do believe Wencor does have a strong case on the surface re: non-delivery of digEs. But many questions arise. There is the fact that EDIG was responsible for manufacturing oversight and ``knew or should have known`` issues, assuming the digEs weren`t produced. But I have a suspicion that those digEs were produced on schedule, inspected and accepted by Wencor in January (why else make the trip and make a direct final payment?), and that those digEs are locked up in a shipping container somewhere. Just my suspicion.... Other stuff flows from that, and I recently suggested that perhaps there was a scheme in place between Wencor and Maycom where both would benefit at EDIG`s detriment. A piece of that being the fact that EDIG is going to use a different supplier eVU.
One avenue EDIG could relatively easily pursue in an ``effort`` against Maycom is that Maycom is most likely ISO9001 certifed, and having failed to deliver (after accepting payment) is not only criminal, but also puts their ISO certifiation at risk (which would jeopardize Maycom`s business relations with other customers). EDIG should report Maycom to the ISO board.
I could go on and on (as ya`all KNOW, LOL), but that`s my basic take, and a possible action that could be initiated by EDIG NOW at very little expense.
I should clarify a little on one point: the ``delay``. It`s really more than that. Not only is there a probable delay in EDIG contracts being executed for eVU (what customer will go forward knowing that their supplier, EDIG, has such ``issues`` surrounding the product?), but the possible loss of business. We are not the only game in town, and though our product may indeed be superior to competition, if the prospective customer wants to roll out portables by a date certain, THAT is their bigger issue, NOT which device is selected - they`ll pick the device that is available, without a lot of hair on it, to meet their schedule.
Not good. If we prevail in litigation, I suppose we could pursue damages for any lost business, but how to quantify the ultimate loss in sales and credibility? And get paid for it?
BTW, I wouldn`t be surprised if we don`t hear anything from EDIG till near the end of the qtr. That, I believe was the publically stated commitment, and they are not IMO necessarily obligated to satisfy a commitment made to individual shareholders via email or telcom.
But, alas, I KNOW nuttin`!
